Sataşmayı somutlaştıracak olursak; ufak tefek saçma sebeplerden bir işçiye bağırmak tehdit etmek fiili saldırıda bulunmak olarak genelleştirebiliriz. Elbette birbirinden farklı sataşma halleri mevcut. Cinsel taciz başka bir bend’de düzenlenmiştir. Sataşma kapsamında değerlendirilen davranışlar içine girmez. Sataşmadan daha ağırdır ve bir başka yazıda irdelenmiştir. Bu yazıda neler sataşma olur örnekler vererek fikir oluşturmaya çalışacağım.

Ve karşılıklı yumruklaşmalar. Gördüğünüz gibi gerzekçe bir kavga izledik. Bu durumda her iki işçi de işyerinde kavga ettiğinden iş akitleri feshedilmiştir. Yargı bu fesihleri haklı bulmuştur. Meşru müdafaa kapsamında olmamak şartıyla kendisine yönelen sataşmaları işçi, işverene bildirmek zorundadır.  Buna rağmen işveren önlem almazsa işçi haklı durumda olur. Yani hem saldırıya uğrayıp hem de işten atılmak gibi bir durum yok. Aynı şekilde kendisine saldıran kişiye karşı koymak da işten atılma sebebi değil elbette. Teorik detaylara girmeden Yargıtay kararlarından örnekler vermek daha öğretici olur diye düşünüyorum.

Davacı, iş sözleşmesinin geçerli neden olmadan feshedildiğini belirterek feshin geçersizliğine ve işe iadesine karar verilmesini istemiştir. Tanık anlatımları, CD çözümleri ve diğer belgelerle davalı işvereni temsil eden belediye başkanı kapısına bir takım sıvı şeyler sürülmesi, kapısı önüne sıvı dökülmesinin sabit olması halinde olayın basına da domuz büyüsü olarak yansıması karşısında, bu tür davranışların işveren ve temsilcisinin haysiyetini kırıcı, itibarını zedeleyici ve sonuç olarak sataşma niteliğinde olacağı kaçınılmazdır. Ayrıca irade fesadı bulunmaması halinde davacının diğer işçiyi tehdit etmesi de sataşma niteliğinde bir davranış olacaktır. Bu durumda davacının davranışlarının işyerinde olumsuzluklara yol açtığı, iş ilişkisinin işveren açısından önemli ölçüde devamının beklenmez bir hal alacağı kuşkusuzdur. Bu olguların tespiti halinde feshin geçerli nedene dayandığı kabul edilmeli ve istem reddedilmelidir.

 

         Zaman zaman büyü var mı yok mu tartışmaları yapılır. Yargıtay’ın bu kararı ile büyünün varlığı da ispatlanmış durumda. Bu şekilde saçma hareketlerle işvereni ya da başka bir işçiyi rahatsız etmek bence son derece doğru biçimde sataşma olarak değerlendirilmiş Yargıtay tarafından. Somut olaya göre neyin sataşma olduğu neyin olmadığı tartışılarak sonuca varılmaktadır. Ancak genel olarak kavga etmek küfür etmek işvereni ya da başka işçiyi rahatsız etmek sataşma olarak değerlendirilmektedir.

İşverenin kendisine ait bilgisayar ve e-mail adresleri ile bu adreslere gelen e-postaları her zaman denetleme yetkisi bulunmaktadır. Davalı işverene ait bilgisayarları ve e-mail adreslerini özel yazışmalarda kullanıp işverene hakaret niteliğinde sözler sarf etmenin, işveren açısından 4857 sayılı Yasanın 25 II-b.maddesi uyarınca sataşma niteliğinde haklı fesih nedeni oluşturacağı anlaşılmakla davacının ihbar ve kıdem tazminatı taleplerinin reddi yerine yazılı gerekçe ile kabulü hatalı olup bozmayı gerektirmiştir.

         Yani patronun verdiği bilgisayar ile ve onun verdiği mail üzerinden kendisinin dedikodusunun yapmayın veya sövmeyin. Aksi takdirde tazminat alamazsınız.

Aşağıdaki kararda kavga eden iki işçiden biri işten çıkartılmış, diğerine sadece uyarı cezası verilmiş ve işe devam ettirilmiştir. Objektif olarak haklı konumda olan kişinin işten çıkartılamayacağına dair güzel bir karardır.

Somut olayda, davacı işçinin tıkanan su borusunu açmaya çalıştığı bir sırada diğer bir işçinin üzerine su sıçratması sonucu, diğer işçinin “kör müsün dikkat etsene” demesi üzerine elindeki temizlik aletinin metal kısmı ile diğer bayan işçinin kafasına vurduğu, yaralanmasına sebep olduğu ve özel hastaneye kaldırılarak tıbbi müdahale yapıldığı dosya içindeki bilgi ve belgelerden anlaşılmaktadır. Davacı işçi de olayı kabul etmiş ve sağ gözündeki özür sebebiyle diğer işçinin sarf ettiği sözlerin kendisini etkilediği bir an için bu olayın olduğunu ve özür dilediğini bildirmiştir.

Davacının bir gözünde görme özrü olduğu dosya içindeki bilgi ve belgelerden sabit olsa da, diğer işçinin söylemi hakaret kastını taşımayıp, üzerine sıçrayan su üzerine bu tepkiyi göstermiştir. Diğer işçinin iş sözleşmesinin feshedilmemiş olması da, işverenin eşit davranma borcuna aykırılığı göstermemektedir. Gerçekten olayın iki tarafı olan her iki işçinin eylemleri arasında denklik de bulunmamaktadır. Bu bakımdan işverence diğer işçiye uyarma cezası verilmesi ile yetinilmesi, fesihte eşit davranma borcuna aykırılık olarak değerlendirilemez.

         Yani arkadaşının kafasına demirle vuran işçi “zaten tek gözüm görmüyor bana kör deyince yapıştırdım kafasına” diyerek haklı çıkmaya çalışmış ama Yargıtay bu savunmayı yememiştir. Diğer işçi ise “kör müsün” demek yerine daha kibar olabilirdi. Ancak kibar olmadı diye de işten çıkartılamaz. Bu gibi olaylarda kişilerin sosyo-kültürel yapılarının da göz önünde bulundurularak tepkilerinin buna göre ölçülmesi de zorunludur.

         Özet olarak her kavgaya karışıldığında işten çıkartılmanın haklı gerekçesi oluşmaz. Objektif olarak haklı durumda olmak ve kendisine yönelik sataşmaya “mümkün olduğunca” karşılık vermemek gerekir. Bu sınırlar her sosyal bilim alanında olduğu gibi soyut olup somut olaya göre belirlenecektir.

İstifa Kamu Hukuku’na has bir kavramdır. İş Hukuku’nda fesih olur. O da haklı mı haksız mı ona bakılır.” Diye bilgileri döktürmeye başlarlar. Bu terminoloji fetişistlerini gören uygulamacı adını verdiğimiz avukat ve yargıç takımı ellerini ağızlarına götürüp rahatlıkla “geldi yine tipini bilmem ne yaptığım” diyebilirler. Haklarıdır. Bu terminoloji tartışmaları yüzünden konuya bir türlü girilemez. Bakınız bir paragraf gitti. Ben de severim gerçi terminoloji tartışmasını ve İş Hukuku’nda istifa olmaz diyen zevata moda bir yanıt vermek istiyorum: Yav he he!  İSTİFANIN NİTELİĞİ

         Yargıtay kararlarında ve buna paralel olarak yerel mahkeme kararları, avukat layihaları ve diğer uygulamaya has evraklarda istifa ilk akla gelen anlamıyla, yani tek taraflı olarak iş ilişkisini bitirmek anlamında kullanılır. Bu durum elbette aynı zamanda fesihtir. Haklı olmasına ya da olmamasına bakılarak da işçinin tazminat hakkı doğup doğmayacağı belirlenir.

 İSTİFA EDEN İŞÇİ KIDEM TAZMİNATINA HAK KAZANIR MI?

          Kestirmeden cevap veriyorum: Kazanır. Kendi isteğiyle iş akdini fesheden işçinin haksız nedenle akdi feshettiği bu nedenle tazminat alamayacağı çok genel bir bilgidir. İşçi iş akdini kendi isteğiyle feshetmiş, hatta baskı altında kalmadan noter kanalı ile istifaname başlıklı bir istifa yazısı gönderip bu yazıda “kendi isteğimle istifa ediyorum” demiş de olabilir. Eğer işçinin bu şekilde istifa iradesi gösterdiği anda fazla mesai alacağı, ücret alacağı veya başka bir alacağı varsa gönderdiği bu istifaname başlıklı yazı haklı nedenle derhal fesih sayılır. Böylelikle işçi iş akdini haklı nedenle feshettiği için kıdem tazminatına da hak kazanacaktır.

         Yargıtay, işçiye alacakları zamanında ödenmiyor ise ya da yasadan doğan bir hak (ücretsiz doğum izni vs.) verilmiyorsa işçinin kendi isteğiyle işten ayrılmasını haklı nedenle fesih olarak kabul etmektedir. (Meraklısı için. Yargıtay 9. Hukuk D. 2010/5907 E.  2012/13018 K. – 9. Hukuk Dairesi 2010/30912 E. 2010/25745 K.)

         Eşitler arasındaki bir ilişki düşünülecek olursa; bir tarafın ortaya koyduğu iradenin kabul edilmeyerek onun yararına olan başka bir şekilde algılanması, diğerine haksızlık yapılması anlamına gelecektir. Örneğin alacağımdan vazgeçtim diyen bir tacirin bu yazısına “saçmalama oğlum o kadar çalıştın kazandın, fevri davranma” deyip “aslında bu yazıda alacağını istemektedir” diye yorum yapan bir mahkeme olmaz. Ancak işveren karşısında işçiyi, açıkça güçlü karşısındaki zayıf kabul eden Yargıtay işçiyi “o öyle demek istemedi” diye korumaktadır. Bu durumun haklılığı bana göre mevcut burjuva hukuk sistemi içerisinde üretilecek bir düşünce ile tam olarak anlaşılamayacaktır. Bu nedenle İş Hukuku’nun adil olmayan bir hukuk dalı olduğu, işçi çalıştıran insanların mağdur edildiği, işçilerin bu sonsuz haklılık karşısında sürekli suiistimallerde bulunduğu gibi itirazlar sıkça görülmektedir. Dediğim gibi işçilerin haklılığını mevcut burjuva hukuk pratiğine bağlı kalarak savunmak manasız bir durum. Yaşamak için çalışmak zorunda olan ve zengin olmak, başarılı olmak gibi hırsları olmayan bir insanı düşünelim. Bu insan hayatını insanca devam ettirebilmek için çalışmak zorunda. Yani hayatının belli saatlerini bir başkasının çizdiği sınırlara göre onun istediği yerde geçirmek ve bir şeyler yapmak zorunda. Bu durumun normalleşmiş olması ve adına mesai deniliyor olması korkunçluğunu ortadan kaldırmaz. Koca bir yılda 10-15 gün, daha şanslı olanların ise 1 ay tatil yapabildiği ve istediği gibi davranabildiği, yani isterse dışarıda bir bankta oturabildiği, isterse bira içebildiği, ya da evde kediyle birlikte yatabildiği vs. zaman dilimi bu kadar. Sanayi Devrimi dönemine göre şanslılar ama sürekli kötü misaller verip şükredilmesini istemek neyin nesidir ben cevap vermeyeyim. Hukuk teknokratı olarak pek çok savunma getirilebilir. Ama kafamızı kaldırıp gökyüzüne baktığımızda ve insan olduğumuzu hatırladığımızda fakirin zenginden hep alacaklı olduğunu anlarız.           Tembellik Hakkı’nın temel insan haklarından olduğunu savunmak pozitif hukukta pek kabul görmez. Bu şekilde konuşmaya başladığınızda sizi Hukuk Felsefesi alanında çalışma yapmaya iterler. Mer’i mevzuat ekseninde Yargıtay’ın tavrını eleştirirsek kanun koyucunun iradesini de peşinen kabullenmiş oluruz. Ben daha geniş bir perspektiften bakıyor ve işçinin tarihsel olarak kapitalist karşısındaki güçsüzlüğünden ve iki türün yaşam kalitelerindeki farktan hareketle işçinin canı istediği zaman işi bırakarak kıdem tazminatı alması gerektiği görüşünü savunuyorum.

İŞYERİNDE CİNSEL TACİZ

Cinsel taciz, modern insanın modernleşmesiyle ters orantılı biçimde ürettiği bir eylem. Büyük oranda failin erkek mağdurun kadın olduğu bir suç türü. Cinsel taciz, sosyo-ekonomik katmanlara göre şekil değiştiriyor, ancak kadın ruhunda aynı tahribata yol açtığı bir gerçek.

Yazımızın konusu ceza hukuku anlamında değil, iş hukuku anlamında iş yerinde cinsel taciz. Elbette bu tacizin sonuçları ve neler yapılabileceğine dair fikirler verilmesi amaçlanmaktadır.

Doğrudan konuya girerek neler taciz neler değil ayırabilir miyiz sorusunu soralım? Sosyal bilimlerin en sosyal olanı hukuk, hiçbir soruya kısa ve net cevap vermez, veremez. Ben de vermiyorum. Hangi hareketler taciz olur hangisi olmaz böyle bir ayrım yapamayız. Ancak kadınlar ve dikkatli gözler neyin taciz olduğunu hemen anlar. Duruma göre bir bakış taciz olabilirken, sarılmak taciz olmayabilir.

Kadın erkek arasındaki (son günlerin meşhur tabiri belki ama doğru bir hukuki tabirdir ) “rızaya” dayalı ilişkiler taciz olarak değerlendirilmez. Bununla birlikte rıza var diye genel ahlaka ve iş disiplinine aykırı biçimde bazı hareketler sergilemenin de normal olmadığını söylemeye gerek yok sanırım. Cinsel tacize maruz kalan bir çalışan ne yapabilir?

 İŞVERENİN TACİZ ETMESİ DURUMU

Eğer işveren işçiyi taciz ederse işçi haklı nedenle işten ayrılabilir.

İş Kanunu’nun 24/II-b maddesine göre

İşveren işçinin veya ailesi üyelerinden birinin şeref ve namusuna dokunacak şekilde sözler söyler, davranışlarda bulunursa veya işçiye cinsel tacizde bulunursa.

İşçi haklı nedenle iş akdini derhal feshedip, tazminat almaya hak kazanır. Bununla birlikte cinsel taciz Türk Ceza Kanunu’nun 105. Maddesine göre suç olarak nitelendiğinden, mağdur, Cumhuriyet Başsavcılıklarına şikayette bulunursa taciz eylemini yapan kişi ceza alacaktır. TCK m:105 şu şekildedir.

Madde 105 – (1) Bir kimseyi cinsel amaçlı olarak taciz eden kişi hakkında, mağdurun şikâyeti üzerine, üç aydan iki yıla kadar hapis cezasına veya adlî para cezasına hükmolunur. 

(2) (Değişik fıkra: 29/06/2005-5377 S.K./13.mad) Bu fiiller; hiyerarşi, hizmet veya eğitim ve öğretim ilişkisinden ya da aile içi ilişkiden kaynaklanan nüfuz kötüye kullanılmak suretiyle ya da aynı işyerinde çalışmanın sağladığı kolaylıktan yararlanılarak işlendiği takdirde, yukarıdaki fıkraya göre verilecek ceza yarı oranında artırılır. Bu fiil nedeniyle mağdur; işi bırakmak, okuldan veya ailesinden ayrılmak zorunda kalmış ise, verilecek ceza bir yıldan az olamaz.

Bununla birlikte hukuk mahkemelerinde tazminat davası da açılabilir.

Buraya kadar konu net gibi. Ya bir çalışan diğer çalışanı taciz ederse bu durumda ne olacaktır?

BİR İŞÇİNİN DİĞERİNİ TACİZ ETMESİ DURUMU

Bu durumda da İş Kanunu m:25/II-c uyarınca işveren, bir çalışanı taciz eden diğer çalışanı tazminatsız olarak işten çıkartabilecektir. Yukarıda saydığımız şikâyet ve tazminat davaları bu durumda da mağdur tarafından taciz fiilinde bulunan kişiye karşı açılabilecektir. Esas tartışma, bir çalışanın diğerini taciz ettiğinde işverenin buna karşı ne yapacağı noktasında toplanmaktadır. İş Kanunu m:25/II-c

 İşçinin işverenin başka bir işçisine cinsel tacizde bulunması halini işverenin haklı nedenle derhal fesih hakkı olarak düzenlemektedir. Ancak işveren bu durumu görmezden gelir, tacizci kişiyi işten çıkarmaz ya da gerekli tedbirleri almazsa mağdur işçi ne yapabilecektir? Bu durum da kanun koyucu tarafından düşünülmüş ve mağdur çalışana haklı nedenle fesih imkanı tanınmıştır. İş Kanunu’nun 24/II-d maddesi şu şekildedir.

İşçinin diğer bir işçi veya üçüncü kişiler tarafından işyerinde cinsel tacize uğraması ve bu durumu işverene bildirmesine rağmen gerekli önlemler alınmazsa.

Bu durumda da işçi işten ayrılarak tazminat alabilecektir. Bir çalışanı taciz eden diğer çalışan, işveren için vazgeçilmez bir eleman olabilir ve işveren bu çalışanı işten çıkarmak istemeyebilir. Bu durumda tacizin tekrarlanmaması için gerekli tüm tedbirleri almakla mükelleftir. Eğer gerekli tüm önlemler alınmış ise bu durumda taciz mağduru işçi haklı edenle işten ayrılamaz. Ancak bu son derece hassas bir durumdur. Örneğin büyük bir fabrikada çalışan bir işçi, yan odada çalışan bir başka işçiyi sürekli odasına giderek, sözle, bakışla ya da bir başka şekilde taciz etmekteyse ve mağdur işçi bu durumu işverene bildirdiğinde, işveren tarafından tacizci işçi mağdurla karşılaşmayacak kadar uzakta başka bir odaya transfer edilirse bu durumda gerekli önlemler alınmış olacak mıdır? Bu soru her somut olay için farklı cevaplanabilir.

Ancak kanaatimce kadınların işyerinde tacize uğramaları sonucu tacizci kişinin işten çıkartılmaması durumunda kadının orada çalışmaya devam etmesini beklemek haksızlık olacaktır. Bu nedenle bu hüküm son derece istisnai hallerde uygulanmalıdır. Erkek bakış açısıyla “yerini değiştirdik daha ne yapalım” gibi kadını arka planda bırakan değerlendirmelerin hak ettiği sıfatı yazımızda kullanıp seviyeyi düşürmeyelim.

Avukatlık yaşamımda teorinin pratik karşısında yaratıcılık anlamında solda sıfır kaldığını gördüm. İnsanın hayal gücünü aşan olaylar sıkça yaşanmakta. Ben sıradan örnekler vereceğim. Yargıtay kararlarından seçmeler aşağıdadır.

1-    İlk olayımız şudur. Eğitim çalışması için şirket işçileri şehir dışına götürüp otele yerleştirmiştir. Akşam saatlerinde de bir toplantı yapılmış ve alkol alınmıştır. Kafayı çeken bir abimiz önce bir başka çalışan olan mağdur ablamıza içki ısmarlamak istemiş, sonra gece 24:00 gibi odasını arayarak kendi odasında su kalmadığını gelip almak istediğini söylemiştir. Ertesi günü olay patronun kulağına gitmiş patron abimizi işten çıkarmıştır. Abimiz iş mahkemesinde işe iade davası açmıştır. İş Mahkemesi alınan alkolün etkisiyle bu tür girişimler olabileceğini, bu hareketlerin taciz boyutuna varmadığını kabul edip abimizi işe iade etmiştir. Yargıtay ise

Her ne kadar davalı işveren çalışanı olup tacize uğradığını beyan eden kadın işçi, duruşmadaki beyanlarında, şikayet dilekçesinde belirtilen hususlar ile ilgili bir kısım çelişik beyanlarda bulunmuş ise de, bu çelişkili beyanlarının davacının eylemlerini ortadan kaldırmadığı, yine dinlenen davalı tanık beyanları ve tüm dosya kapsamı birlikte değerlendirildiğinde 22 Ekim 2011 günü akşamı gala yemeği ile başlayan ve gece 00.30 sularında kadın işçinin odasının aranarak odaya gelip su almak isteğiyle sonuçlanan davranışlarının sırnaşık nitelikte süreklilik arzeden ve kadın işçiyi rahatsız eden söz ve eylemler bütününü oluşturduğunu, bu eylemlerin psikolojik ve cinsel taciz boyutunda olduğu ve bu hali ile işverenin kadın işçinin kişiliğini korumak ve saygı göstermek yanında işyerinde ahlak ve dürüstlük kurallarına uygun bir çalışma ortamı sağlamakla yükümlü olması ve özellikle de işçilerinin psikolojik ve cinsel tacize uğramamaları ve bu tür tacizlere uğramış olanların da daha fazla zarar görmemeleri için gerekli önlemleri almakla yükümlü olduğu düşünüldüğünde davacının 4857 sayılı Yasanın 25/2-c bendi uyarınca iş sözleşmesinin feshedilmesinin haklı nedene dayandığı ve feshin süresinde yapıldığı sonucuna ulaşılmakla davanın reddine karar verilmesi gerekirken kabulü yönünde hüküm kurulması hatalıdır.

Gerekçesiyle kararı bozmuş, yani bu hareketlerin taciz olduğuna ve taciz eylemlerini gerçekleştiren kişinin işten çıkarılmasının doğru olduğuna hükmetmiştir.

2-Yargıtay tacize uğrayan kadının bunu ispatlayamamış olması durumlarında da durduk yerde böyle bir iddiada bulunması için bir sebep bulunmaması, uzun süredir çalıştığı, ayrılması için mantıklı bir sebep bulunmaması gibi olgular karşısında tacizin varlığını kabul etmektedir. Bir şirketin genel müdürü, başka bir çalışanı taciz etmekte elle, sözle tacizleri sürdürmekte ve kadın reddettiği halde aralarında ilişki varmış izlenimini yaratmaktadır. Kadın ise yıprana yıprana bitik duruma gelip sinir krizi geçiriyor ve işten ayrılıyor. Mahkeme tacizi ispatlayamadığı için kadının davasını reddediyor. Yargıtay ise kadını haklı bulup kararı bozuyor.

Dosya içerisinde mevcut delilerin ve tanık anlatımlarının bütünlük içinde değerlendirilmesi neticesinde; davacının olayları yer ve zaman belirterek ayrıntılı biçimde anlatarak kendi iffetini herhangi bir sebep yokken ortaya koyması yaşamın olağan akışına aykırıdır. Öte yandan özellikle işçinin işyerinde ve işyeri dışında amiri tarafından tacize uğradığını belirtip ihtarname göndererek tüm detayları belirtmesi ve tacizde bulunanın amiri konumunda olan genel müdür olması karşısında taraflar arasındaki iş ilişkisinin varlığı işverenin konumunu daha da ağırlaştırmaktadır. Davacının arkadaşı olan tanıklar davacı gibi işyerinde çalışırken tacize uğrayıp performans notu düşük gösterilen başka bir işçinin ismini de bildirmişlerdir. Taciz olayının etki ve sonuçları temadi etmekte olup davacının olayların vahameti neticesinde psikolojik bunalıma girmesi, daha evvel performansına ilişkin olumsuz bir değerlendirme bulunmamasına rağmen bu olaylardan sonra performans notunun düşürülmesi, 21.7.2006 tarihinde işyerine ihtarname çekerek işverenden amiri hakkında soruşturma başlatılarak gerekli tedbirlerin alınmasını istemesi ve akabinde 1.8.2006 tarihinde de iş akdini bu olaylar nedeniyle feshetmesi nedeniyle temadi eden ve sonuçları itibariyle bir nevi mobbinge dönüşen eylemler karşısında 6 günlük hak düşürücü sürenin geçtiğinden de bahsedilemez. Akdin davacı kadın işçi tarafından feshi haklı olup kıdem tazminatının hüküm altına alınması gerekirken hatalı değerlendirme ve gerekçe ile reddi bozmayı gerektirmiştir.

Görüldüğü gibi her şeyin kötü TV dizilerindeki gibi kamera kayıtlarıyla hakimin önüne konulması gerekmiyor. Olayla tümüyle değerlendirildiğinde tacizin yaşanıp yaşanmadığını tespit etmek çok zor değil. Buna benzer pek çok örnek verilebilir.

Edep dışı söz ve resim göndermek, ima içeren yakıştırmalar yapmak     ve benzeri davranışlar da taciz olarak değerlendirilmektedir. Nadir görülmekle birlikte bir kadının erkeği taciz etmesi de aynı hükümlere tabidir. Kadın tacizi uygulamada genellikle, kendisiyle birlikte olmak istemeyen erkeği, iftira atacağı tehdidiyle yıldırmaya çalışmak şeklinde görülmektedir. Aynı şekilde tacizin karşıt cinsiyetten gelmesi de şart değildir.

Tacize uğrayan kişiler şunu bilmelidir ki, zaman geçirmeksizin gerekli başvurularda bulunur iseler sonuç almaları zor değildir. Tacizsiz günler…
